Terms of service

These terms apply to the Mitten Seed Co. website and store at mittenseeds.com and to every order placed through it. By using the site or placing an order, you agree to them.

Our products

We sell seed packets and pollinator seed gift sets. Product descriptions, species lists, and photos are as accurate as we can make them, but seed mixes are natural products and the exact proportions in a packet can vary. Photos of blooms show what the varieties look like when grown, not a guarantee of what any one planting will produce.

Growing results

Seeds are living things. Whether they sprout and bloom depends on soil, weather, timing, water, light, and a hundred other things we can't control. Our planting directions, guides, and any growing assistant we offer are provided to help, and we offer them in good faith, but we don't guarantee germination, bloom, or any particular result, and our liability for any planting is limited to the price you paid for the seed.

Orders and payment

An order is accepted when we send you a confirmation. We may cancel or limit an order if a product is unavailable, if there's an error in the price or description, or if we suspect fraud; if we do, we'll refund anything you've paid. Prices are in US dollars and may change without notice, but the price you paid at checkout is the price you pay. Sales tax is added where required. Payment is processed by Shopify Payments and the express checkout providers shown at checkout.

Shipping

We ship within the United States. Shipping terms, timing, and any free shipping offer are as stated at checkout and on our shipping policy page. Risk of loss passes to you when the carrier delivers the package.

Returns and refunds

Because seed is perishable and can't be resold once it leaves us, we generally can't accept returns of opened seed packets. If an order arrives damaged, if we sent the wrong item, or if something else goes wrong, contact us within 30 days of delivery and we'll make it right. Details are in our refund policy.

Amazon purchases

Some of our products are also sold on Amazon, and our site links to those listings. Orders placed on Amazon are governed by Amazon's terms and handled through Amazon's customer service, not these terms.

Your account and content

If you create an account, keep your password private and tell us if you think it's been used without permission. Anything you submit to the site (a message, a review, a journal entry if we offer one) must be yours to share, lawful, and not harmful to others. You keep ownership of what you submit, and you give us permission to use it to run the site and the service you submitted it to.

Our content

The text, photos, logos, packaging designs, and other content on this site belong to Mitten Seed Co. or our licensors. You may view and print pages for your own use. Please don't copy or reuse our content commercially without asking first.

Acceptable use

Use the site lawfully. Don't attempt to access systems or data you aren't authorized to, interfere with the site's operation, or use automated tools to place orders or extract content without our permission.

Links to other sites

We link to other websites, including Amazon. We're not responsible for their content or practices.

Limitation of liability

To the fullest extent the law allows, Mitten Seed Co. isn't liable for indirect, incidental, or consequential damages arising from the site or your purchases, and our total liability for any claim is limited to the amount you paid for the product in question. Some states don't allow these limits, so they may not apply to you.

Governing law

These terms are governed by the laws of the State of Michigan and the United States. Any dispute will be handled in the state or federal courts located in Michigan, unless the law gives you the right to bring it elsewhere.
